Terms of Service

You must be at least 18 years old and capable of entering into a legally binding agreement to use our platforms. By using our platforms, you represent and warrant that you meet these requirements.

If you are using our platforms on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

Some features require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate your account if we reasonably believe that your account has been compromised or that you have violated these Terms.

When you purchase products through store.insynapse.com, the following terms apply:

• Pricing: All prices are listed in Indian Rupees (INR) unless otherwise indicated. Prices are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time without prior notice.
• Payment: Payments are processed securely through Razorpay. By making a purchase, you agree to Razorpay's terms of service.
• Order acceptance: Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is confirmed only when we send you an order confirmation.
• Product descriptions: We make every effort to accurately describe and display our products. However, we do not warrant that product descriptions, images, or other content are error-free.
• Returns and refunds: Please refer to our Refund & Return Policy for details.
• Shipping: Please refer to our Shipping Policy for delivery details.

Our mobile applications (WellVoye and AIPhoneBook) are distributed through the Apple App Store and Google Play Store. In addition to these Terms, your use of the apps is subject to:

• The applicable app store's terms of service
• Any in-app subscription or purchase terms presented at the time of transaction
• The permissions requested by the app (which you can manage through your device settings)

App subscriptions and in-app purchases are processed by Apple or Google, as applicable. Refunds for app purchases must be requested through the respective app store.

All content on our platforms — including but not limited to text, graphics, logos, icons, images, software, and the design and arrangement thereof — is the property of InSynapse Technologies India Private Limited or its licensors, and is protected by Indian and international intellectual property laws.

You may not, without our prior written consent:

• Copy, modify, distribute, or create derivative works from our content
• Reverse engineer, decompile, or disassemble any of our software
• Use our trademarks, logos, or brand names in any manner that suggests endorsement or affiliation
• Frame, mirror, or scrape any part of our platforms

You agree not to:

• Use our platforms for any unlawful purpose or in violation of any applicable law
• Interfere with or disrupt the integrity or performance of our platforms
• Attempt to gain unauthorised access to any part of our platforms or systems
• Use automated tools (bots, scrapers, crawlers) to access our platforms without our written permission
• Transmit any viruses, malware, or other harmful code
• Impersonate any person or entity, or falsely claim an affiliation
• Use our platforms to send unsolicited communications (spam)
• Engage in any activity that could damage, overburden, or impair our infrastructure

We use WhatsApp Business API to communicate with customers for order updates, support, and promotional messages. By initiating a conversation with us on WhatsApp or providing your WhatsApp number:

• You consent to receive messages from us via WhatsApp
• You can opt out at any time by replying "STOP" or by contacting us
• Message and data rates from your mobile carrier may apply
• Your WhatsApp communication is also subject to WhatsApp's own terms and privacy policy

Our platforms and services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• Our platforms will be uninterrupted, timely, secure, or error-free
• The results obtained from using our platforms will be accurate or reliable
• Any defects in our platforms will be corrected

Smart home devices sold through our store are manufactured by third parties (such as Aqara and Govee). We are an authorised reseller and do not manufacture these products. Product warranties are provided by the respective manufacturers.

To the maximum extent permitted by applicable law, InSynapse and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

• Your use of or inability to use our platforms
• Any unauthorised access to or alteration of your data
• Any third-party conduct or content on our platforms
• Any products purchased through our store (beyond the product purchase price)

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or INR 10,000, whichever is greater.

You agree to indemnify, defend, and hold harmless InSynapse, its directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of our platforms, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days of receiving your notice.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
